Nepenthe Ltd is responsible for the web transactions and we offer either Sage Pay or PayPal to collect/process the payment transaction information, Nepenthe Ltd is also Trustwave compliant.

General

All prices on the website are given in UK Pounds Sterling, and all payments must be made in UK Pounds Sterling. All agreements of your offer to purchase goods are entirely subject to their availability. Our acknowledgement of order acceptance via e-mail or web is not a guarantee of delivery. In the event the items you have ordered are not available, you will be contacted, and alternative or a full refund offered. If we are only able to fulfill part of your order, payment will be taken for your whole order, then on dispatch a full refund for the unavailable goods will be made.
Payments can be made using any of the methods listed in the below payments section. The total amount will be debited from your account when we have accepted your offer to purchase goods from us.

These Terms and Conditions along with our Invoice and Privacy Policy Constitute the agreement between you and us relating to the provision of goods you have offered to purchase. These conditions supersede all other proposals both aural and written.

Terms of Sale

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Please see our Delivery Charges notice for further information.
In order to contract with nepenthe you must possess a valid credit or debit card issued by a bank acceptable to us. nepenthe retains the right to refuse any request made by you. If your order is accepted we will inform you by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

Our Contract

Upon ordering we are not making a legal offer to provide the goods ordered. When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit or debit card.

Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Where applicable, prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.
The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. Payment

Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.

The conditions of use relating to any discount code will be specified at the time of issue.
These T&Cs relate to all nepenthe promotions, competitions and discount codes (unless otherwise stated).

Delivery

We aim to deliver all orders as quickly as possible. Delivery times stated on the website are in no way a guarantee and are based on approximations. This is due to third party factors, that may cause delays.

Our Returns & Refund Policy

Our web store returns policy means that if you are not fully happy with the goods you have received, you have 14 days to let us know if you would like to return the goods, starting the day after you receive them.  Alternatively, you can complete the Returns form and send the goods back to us within that time, providing they are in original resalable condition. Once returned you will be entitled to receive an exchange or a refund.  Return postage costs are non-refundable. We are not able to refund or exchange items that appear to have been worn, washed, or are not in original condition. This does not affect and is in addition to your statutory rights as a consumer. Please enclose the completed Returns form with your goods, as no form may result in taking longer to process the return. Please make sure all returned items are well packaged, so as not to be damaged in the post. We strongly advise all return packages are sent with a trackable, insured service, as we cannot take responsibility for items damaged or lost in return transit.
